Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and ListJam ("we," "us," or "our") governing your use of the ListJam application ("App") and services. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal devices solely for your personal, non-commercial purposes.
You may not:
- •Modify, disassemble, decompile or reverse engineer the App
- •Rent, lease, loan, resell, sublicense, distribute or otherwise transfer the App
- •Copy, reproduce or distribute the App
- •Remove, circumvent, disable, damage or interfere with security features
Subscription Services
ListJam offers optional premium features through subscription plans managed by RevenueCat. Subscriptions are available in the following durations:
Payment: Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase. The subscription automatically renews unless canceled at least 24 hours before the end of the current period.
Auto-Renewal: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
Managing Subscriptions: You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play after purchase. RevenueCat facilitates the subscription management but does not store your payment information directly.
User Content and Conduct
You retain ownership of any content you create or upload through the App ("User Content"). By using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your User Content solely for the purpose of operating and providing the App services.
Prohibited Activities:
You agree not to upload or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You may not impersonate any person or entity, upload viruses or harmful code, or violate any applicable laws or regulations.
Intellectual Property Rights
The App and all its contents, features, and functionality are owned by ListJam and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our collection and use of your data as described in the Privacy Policy.
Third-Party Services
The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.
RevenueCat Integration: We use RevenueCat as our subscription management platform. Your subscription purchases are subject to RevenueCat's terms of service in addition to these Terms. Payment processing is handled by Apple App Store or Google Play Store, depending on your device platform.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LISTJAM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
Indemnification
You agree to indemnify, defend, and hold harmless ListJam and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the App.
Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately. If you wish to terminate your account, you may delete the App and discontinue use.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts located in California.
Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the App or by other means. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
Apple App Store Additional Terms
If you downloaded the App from the Apple App Store, the following additional terms apply:
Apple has no obligation whatsoever to provide any maintenance or support services for the App.
Apple is not responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any).
Apple is not responsible for addressing any claims relating to the App or your possession and/or use of the App, including product liability claims, regulatory compliance claims, and consumer protection claims.
In the event of any third-party claim that the App infringes intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

Your Agreement
By using ListJam, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms are effective immediately for new users and will be effective for existing users as of the date posted above.
